Summary

The ECJ delivered a judgment on the freedom of expression of an official of the EU. In the present case, the right to freedom of expression cannot be regarded as excessive, since the official remained in a position to express his views freely in the brief at issue, without, however, having the right to present the work of others as being the result of his own work by not mentioning his sources.

Ruling

The Court:

1. Dismisses the appeal;
2. Orders DD to bear his own costs and to pay those incurred by the European Union Agency for Fundamental Rights (FRA).
