Summary

Clause 2(4) of the Framework Agreement on Parental Leave (96/34/EC) does not prohibit an employer from dismissing a worker who had taken parental leave where the dismissal was not due to the application for, or taking of, parental leave.

Ruling

The Court (seventh Chamber):

  1. Dismisses the appeal;
  2. Orders UG to bear her own costs and to pay those incurred by the European Commission.
